Schumer 'Thankful' For John Roberts Scolding Trump

Yes, some judges seek to make law rather than interpret it, but most - as Roberts said - do "their level best to do equal right to those appearing before them".

Trump has been butting heads with Chief Justice John Roberts, who has defended the independence of the federal judiciary.

Inside Elections publisher Nathan Gonzales said onCNN that Trump's criticism of Roberts could further endear him to his conservative base, "There are some Republicans and conservatives who have already turned their back on Chief Justice Roberts because of his involvement in the decision with the Affordable Care Act".

Roberts, who is a Republican and was nominated to the Supreme Court by George W. Bush in 2005, weighed in angrily the next day, issuing a statement to say that politics played no part in the judicial system. Stephen Reinhardt, who died from a heart attack in May 2018, had a reputation as one of the most "liberal" and politically partisan judges on the 9 Circuit.

So after a federal judge in San Francisco issued a restraining order Tuesday against Trump's new policy limiting asylum claims to those made at legal checkpoints, Trump railed against "Obama judge" Jon S. Tigar and the 9th District - which has blocked all three Trump travel bans, including the one upheld by the top court. Many of those decisions have been subsequently overturned by the Supreme Court.

"This was an Obama judge, and I'll tell you what, it's not going to happen like this anymore". He especially criticised judges on California's 9th US Circuit Court of Appeals.

Moments later he told reporters he has "a lot of respect" for the chief justice but added people interpreting the laws "always give us a bad interpretation".

Except when Roberts' decisions are "partisan", such as his "highly political" rulings in Citizens United and other cases. The 9th Circuit recently ruled that Trump's administration is required to consider claims of asylum regardless of where migrants cross the USA border. "It's a disgrace, and I'm going to put in a major complaint because you can not win - if you're us - a case in the 9th Circuit", Trump said.

Trump supporters often counter critiques of the President's unrestrained leadership style by saying he is doing exactly what he promised to do - shake up the Washington establishment and break the codes of behavior followed by traditional politicians.

As of Thursday morning, President Trump was still ruminating on a rare upbraiding from Supreme Court Chief Justice John Roberts, continuing attacks against the 9th Circuit Court of Appeals and calling it "a complete & total disaster". Judge Tigar sits on the bench in San Francisco and is an Obama appointee.
