A newborn who was fighting for his life after being cut from his mother's womb has died.

"It is with great sadness that we inform you of the passing of baby Yovanny Jadiel Lopez", the statement said.

A decision on additional charges will be made once police and the medical examiner's office complete their investigations into the baby's death, prosecutors said Friday.

The baby's condition earlier this week had been dire, his father's lawyer told CNN affiliate WLS.

She and her 24-year-old daughter, Desiree Figueroa, are charged with murder in the death of the baby's mother, 19-year-old Marlen Ochoa-Lopez, and Chicago police spokesman Anthony Guglielmi said Friday that he expects both women will now be charged with murder in the infant's death. After it was believed that the teen was dead, Clarisa allegedly cut the baby boy out of the teen with a butcher knife.

Once Ms Ochoa-Lopez stopped showing signs of life, Clarisa Figueroa cut the baby from her womb and she and her daughter wrapped the teenager's body in a blanket, put it in a plastic bag and dragged it outside to a rubbish bin, according to prosecutors.

A picture surfaced of Figueroa smiling over the baby in hospital, after she arrived covered in blood.

Police spokesman Anthony Guglielmi told USA media today that he expects both women will also be charged with murder for the newborn baby's death.

Julie Contreras, a spokesperson for the family, posted a statement to her Facebook page revealing news of Yovanny's death.

The accused, who remain in custody, will be asked to enter pleas to the charges when they are next in court on June 26.

During her alleged fake pregnancy, Clarisa said she would name her unborn son after her son that died.

She posted on the page again the following month, asking, "Who is due in May" and 'Where is the May mama's at'.

Three weeks after her disappearance, the Chicago Sun-Times reported that police had found Ochoa-Lopez's body in a trash can outside a house on the southwest side of the city.

"Words really can not express how disgusting and thoroughly disturbing these allegations are", Chicago Police Superintendent Eddie Johnson said last month.
